1. Our Trademark
The Shake Trademark is an important business asset of Shake, by Samantha™ and should be treated with a high level of respect. Our trademark identifies and distinguishes Shake Dance Fitness for people all over the world.
We kindly ask that you support our use of our trademarks and use them properly so not to cause any confusion. If you have any questions concerning the proper use of the Shake Trademark, contact us at samantha@shakedancefitness.com.
The brand name “Shake” or “Shake by Samantha” and related word and logo trademarks should only be used to indicate the source of our programs and related products and should not be used to refer to any other programs, products, or services.
The mark has been registered in respect of: Class 21: Class 25: Class 41.
2. Who may use the trademark?
Only those licensed by our Company have the right to use the Trademark.
We ask that our licensees and enthusiasts of our programs everywhere contact us immediately if they become aware of any unauthorised or improper use of any of the Trademarks. You can email us at samantha@shakedancefitness.com.
3. Trademark usage rules
PLEASE OBSERVE THE FOLLOWING TRADEMARK USAGE RULES:
1. ALWAYS USE A TRADEMARK NOTICE:
Always use the appropriate trademark symbol ™ after the trademarks. The appropriate symbols should be used in all printed materials and advertising.
2. ALWAYS USE THE TRADEMARKS DISTINCTIVELY:
The first letter for each of the Trademarks should be capitalised, e.g., “Shake™”, not “shake”. You can also capitalise SHAKE™ in its entirety, underline SHAKE™ or put SHAKE ™ in italics.
3. ALWAYS USE A TRADEMARK DISCLAIMER:
For SHAKE ™, here is an example of an acceptable disclaimer: SHAKE™ and the SHAKE logos are trademarks of Shake, by Samantha. Used under license only.
4. NEVER ALTER THE SHAKE™ TRADEMARKS:
Do not change the graphics, colours, spelling, insert hyphens or combine two words into one.
5. NEVER USE THE SHAKE™ TRADEMARKS AS NOUNS OR VERBS:
For example, never use "SHAKE™” as a verb to describe an exercise program or class. It is proper to say "I love the SHAKE™ program" and improper to say “I love to SHAKE™”.
6. NEVER USE THE TRADEMARKS AS TRADE OR COMPANY NAME:
It is incorrect to use or refer to the Trademarks as a trade name (e.g., company name or facility name). For example, don't name your company with SHAKE™ in the title. Name your company something else and say that it offers SHAKE™ classes or Shake, By Samantha™ classes.
7. NEVER USE THE SHAKE™ TRADEMARKS ON MERCHANDISE:
Only Shake and its authorised partners can use the SHAKE™ Trademarks on merchandise like CD’s, DVD’s, fitness equipment, footwear, clothing and accessories and other products. So, never use the SHAKE™ Trademarks on merchandise (e.g. Don’t make shirts and put the SHAKE™ Trademarks on the shirt).
8. USE OF THE SHAKE™ LOGO
The SHAKE™ Logo was designed to designate products and services developed by our Company and may be used by licensees in their exact form and only to advertise and promote our programs, products, and services. Unless our prior written approval is obtained, the SHAKE™ Logos are never to be used in connection with the manufacture, promotion, offer for sale or sale of any merchandise. The SHAKE™ Logos cannot be altered or modified in any way, nor can they be combined with any other trade names, trademarks, or logos without our express written permission.
9. IN SUMMARY, THE SHAKE™ TRADEMARKS SHOULD NEVER BE USED IN THE FOLLOWING WAYS:
With the letter "S" not capitalised — For example, “shake” or “shake fitness”.
Altered or Modified — For example, "Shakey".
As a Verb — For example, "once you Shake, you’ll never stop".
As a Noun — For example, "Shake is my favourite exercise".
As a Trade Name — For example, "The Shake Studio".
On Merchandise — For example, don’t make “Shake” shirts.
To advertise programs or products not affiliated with Shake.
