In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy notice that you do not agree with, please discontinue use of our services immediately.

1. WHAT WE DO AT SHAKE, BY SAMANTHA™:

 

In short: we collect personal information that you provide to us.

 

  • We collect personal information that you voluntarily provide to us when using our services, express an interest in obtaining information about us or our products and services, when you participate in activities on the services (i.e posting in our online forums/entering competitions), when you register to become a Shake Instructor or otherwise when you contact us.

  • We do not disclose or sell personal data to third parties.

  • We do not disclose personal data to other members of Shake, by Samantha™.

  • Use contact numbers and emails for communication, billing, and general information.

  • Collect information through our website www.shakedancefitness.com.

  • Collect and store information through our online e-commerce booking platform.

2. TYPE OF INFORMATION WE COLLECT:

 

We receive, collect and store any information you enter on our website or provide us in any other way. 

 

Some information such as your Internet Protocol (IP) address and/or browser and device characteristics-is collected automatically when you visit our services such as; login; e-mail address; password; computer and connection information and purchase history. 

 

We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. 

 

We also collect personally identifiable information you provide us which may include:

Shake, by Samantha™ may store personal data held visually in photographs or video clips or as sound recordings. 

 

Payment data: We may collect data necessary to process your payment if you make purchases, such as your debit/credit card number and the security code associated with your payment instrument.

 

Social media login data: We may provide you with the option to register with us using your existing social media account details, like your Facebook, Twitter or another social media account. Any information collected that we collect from your social media account will depend on your social media accounts privacy settings. See point number 9 for more information).

 

Location data: We may collect location data such as information about your device’s location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access our services. We may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). This includes when you access our services using a mobile device. (See point number 8 for more information.)

 

Push notifications: We may request to send you push notifications regarding your account or certain features. If you wish to opt-out from these types of communications, you may turn them off in your device’s settings.

 

Information from other sources:

We may collect limited data from public databases, marketing partners, social media platforms and other outside sources.

 

Instructor areas:

Access to instructor areas is password protected and is not available to members of the public or other instructors. The C.E.O Samantha, has sole access to all of this data.

 

When an instructor discontinues their membership we may retain personal information after accounts have been deactivated, in case of resolving disputes and to protect our legitimate interests. (See point number 10 for more information.)

 

Children’s Privacy: We do not knowingly collect Personal Data from children under eighteen years of age (18). If you are under the age of eighteen (18), please do not submit any Personal Data through the sites. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through the Sites without their permission. If you have reason to believe that a child under the age of 18 has provided Personal Data to us through the Sites, please email us at samantha@shakedancefitness.com and we will delete that information from our records.

  • All information you provide must be true, complete and accurate, and you must notify us of any changes to such personal information. Please see contact details at point number 14.

 

3. HOW/WHEN WE COLLECT INFORMATION:

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 

 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

3.1 When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your title, name, address, email address, and payment card details.

 

3.2 When you send us a message through a contact form we may collect information such as title, name, address, email address, comments, feedback. 

 

3.3 When you subscribe to a newsletter/blog/use the chat forum we may collect information such as your title, name, address, email address.

 

3.4 We may require your credit or debit card account information in order to:

 

  • Make class reservations

  • Make payments

  • Pay a deposit for our services

  • Purchase products from our store

  • Pre-order events/merchandise and to purchase gift vouchers

  • Book an event

 

  • If you register to become a Shake Instructor we will collect relevant personal data such as your name, address, email address, and payment details in connection with your registration to complete the Shake Training. It is necessary to process your personal data in this way for the performance of a contract between you and Shake by Samantha™.

 

  • When an Instructor completes the Online or In-Person Trainings, we will then collect relevant personal data such as your name, email address, payment details in connection with your membership where you will either choose to pay annually or monthly. Again it is necessary to process your personal data in this way for the performance of a contract between you and Shake by Samantha™.

 

  • When you become a certified Shake Instructor we may use your personal data to communicate with you either by email, mail, SMS, phone or other electronic means. We may contact you in regards to the status of your certification, or transactional communications concerning your certification. We may also get in touch in relation to services you may purchase such as offers, promotions, instructor discounts, products, services, events and more.

 

4. WHAT WE DO AND HOW WE USE INFORMATION:

 

We process your information for purposes based on legitimate business interests, the fulfilment of our contract with you, compliance with our legal obligations and/or your consent. We require personal and non-personal information to understand your needs and provide you with a better service, and in particular for the following reasons;

  • To provide users and instructors with ongoing customer assistance and technical support;

  • To enforce our terms, conditions and policies for business purposes, to comply with legal and regulatory requirements or in connection with our contract.

  • To respond to legal requests and prevent harm.

  • For other business purposes i.e data analysis, identifying usage trends, determine the effectiveness of our promotional campaigns and to evaluate and improve our service, products, marketing and your experience. We may use and store this information in aggregated and anonymised form so that it is not associated with individual end users and does not include personal information. We will not use identifiable personal information without your consent.

 

For these purposes we may contact you via email, telephone, text messages, and postal mail.

  • Other users/instructor areas: When you share personal information, i.e instructors posting comments on our chat forum, contributions or other content to the services or otherwise interact with public areas of the services, personal information may be viewed by all users and may be publicly made available outside the services in perpetuity. If you interact with other users of our services and register for our services through a social network (such as Facebook) your contacts on the social network will see your name, profile, photo and descriptions of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our services and view your profile.

  • Promotional information: We may use your personal information to send you promotional information about third parties which we think you may find interesting if you tell us that you wish for this to happen.

 

6. HOW DO WE KEEP YOUR INFORMATION SAFE?

 

We aim to protect your personal information through a system of organisational and technical security measures.

 

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. 

 

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.

 

7. TRACKING SITE VISITS:

 

We may use cookies and other tracking technologies to collect and store your information.

 

Like most websites, this site uses Google Analytics (GA) to track user interaction. We use this data to determine the number of people using our site, to better understand how they find and use our web pages and to see their journey through the website.

 

Although GA records data such as your geographical location, device, internet browser and operating system, none of this information personally identifies you to us. We do not exchange, sell, rent or give away your email address or any other details to other companies.

 

Licensees must email samantha@shakedancefitness.com if they wish for any photography or video material with them in to be removed from social media platforms or the www.shakedancefitness.com website or app. 

 

10. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

 

If you choose to register or log in to our services using a social media account, we may have access to certain information about you from your social media provider. It will often include your name, email address, friends list, profile picture as well as other information you choose to make public on such social media platform (this may vary depending on which platform is concerned).

 

We will use the information we receive only for the purposes that are described in this privacy note or that are otherwise made clear to you on the relevant services. 11. HOW LONG DO WE KEEP YOUR INFORMATION?

 

We keep your information for as long as necessary to fulfil the purposes outlined in this privacy notice unless otherwise required by law. No purpose of this notice will require us keeping your personal information longer than twenty four (24) months past the termination of your user’s account, this includes instructors.

 

We will either delete or anonymise such information when we have no ongoing legitimate business needs to process your personal information.

In some regions, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time by logging into your account.

 

 

13. WITHDRAWING YOUR CONSENT:

Please note however that this will not affect the lawfulness of the processing before its withdrawal, or will it affect the processing of your personal information conduced in reliance on lawful processing grounds other than consent.
